1. Acceptance of Terms

By visiting our Site, creating an account, placing an order, or otherwise engaging with our Services in any manner, you affirm that you are at least eighteen (18) years of age, or the legal age of majority in your jurisdiction if higher, and that you have the legal capacity to enter into this Agreement. If you are accessing or using the Services on behalf of a business, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.
If you do not agree to these Terms, you must immediately discontinue use of the Site and Services. Your continued use of the Site or Services after any modifications to these Terms constitutes your acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of the United States and the applicable state law of the jurisdiction in which Dewey's Pizza operates, including applicable provisions of the Federal Trade Commission Act (15 U.S.C. § 41 et seq.) and, where applicable, the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA).

- Online Ordering: Customers may browse our menu and place orders for pizza, appetizers, beverages, desserts, and other food and beverage items, either for delivery, carryout, or dine-in where available.

3. User Obligations and Prohibited Activities
3.1 User Obligations
As a condition of your use of the Services, you agree to:

- Treat Dewey's Pizza staff and delivery personnel with respect and dignity, refraining from abusive, harassing, or threatening behavior.
3.2 Prohibited Activities
You agree that you will not engage in any of the following prohibited activities when using our Site or Services:
- Using the Site or Services for any fraudulent, deceptive, or illegal purpose, including placing fraudulent orders, using stolen payment credentials, or submitting false chargebacks.
- Attempting to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to our Services through hacking, password mining, or any other means.
- Interfering with or disrupting the integrity or performance of the Site or the data contained therein, including through the use of viruses, bots, worms, or other malicious code.

- Placing orders with no intention to pay or accept delivery, or otherwise abusing our ordering system, promotional offers, or refund policies.
Violation of any of the above provisions may result in the immediate suspension or termination of your account, cancellation of pending orders, and, where appropriate, referral to law enforcement authorities. We reserve the right to pursue all available legal remedies in connection with any violation.
4. Account Registration
To access certain features of our Services, such as order history tracking and saved preferences, you may be required to create an account. You agree to provide truthful, accurate, and complete information during the registration process and to keep your account information updated at all times.
You are solely responsible for all activities that occur under your account. Dewey's Pizza will not be liable for any loss or damage arising from your failure to maintain the confidentiality of your account password. We reserve the right to refuse registration, cancel accounts, or remove or edit content at our sole discretion.
5. Payment Terms

Prices are subject to change without prior notice. Delivery fees, service charges, or other applicable fees will be clearly disclosed at the time of checkout prior to you completing your order.

Refunds will be issued to the original payment method within a reasonable timeframe as permitted by your payment provider. Dewey's Pizza does not guarantee a specific refund processing timeline, as this may vary depending on your bank or card issuer.

8. Disclaimers and "As-Is" Basis
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. DEWEY'S PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT, INFORMATION, SOFTWARE, TEXT, GRAPHICS, LINKS, OR COMMUNICATIONS PROVIDED ON OR THROUGH THE USE OF THE SITE OR SERVICES;
- WARRANTIES THAT THE SITE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, OR THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED;

We do not warrant that the food products ordered through our Services will meet your specific dietary requirements, preferences, or allergen restrictions. Applicable law may not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE FEDERAL AND STATE LAW, IN NO EVENT SHALL DEWEY'S PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
- LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES;
- PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM YOUR USE OF THE SERVICES;
- UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
- ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE TRANSMITTED THROUGH THE SITE BY ANY THIRD PARTY;
- ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICES;
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF DEWEY'S PIZZA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN JURISDICTIONS WHERE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES IS NOT PERMITTED, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
IN ANY CASE, DEWEY'S PIZZA'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO DEWEY'S PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
Some states do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above exclusions or limitations may not apply, and you may have additional rights.
10. Indemnification
You agree to defend, indemnify, and hold harmless Dewey's Pizza, its parent company, subsidiaries, affiliates, officers, directors, employees, contractors, agents, licensors, service providers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms of Service;
- Your use of the Site or Services in a manner not authorized by these Terms;
- Your violation of any applicable federal, state, or local law or regulation;
- Your violation of any rights of a third party, including but not limited to intellectual property rights, privacy rights, or consumer protection rights;
- Any content or information you submit, post, or transmit through the Site or Services;
- Any dispute or issue between you and any third party.
Dewey's Pizza reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Dewey's Pizza in asserting any available defenses.
11. Privacy Policy
Your privacy is important to us. Our Privacy Policy, available on our website at deweys-food.click, describes how we collect, use, store, and share information about you when you use our Services. By using our Services, you consent to the collection and use of information as described in our Privacy Policy, which is incorporated into these Terms by reference.

12. Food Safety and Allergen Notice
Dewey's Pizza takes food safety seriously and adheres to all applicable federal and state food safety regulations, including those established by the U.S. Food and Drug Administration (FDA) and applicable state health departments. However, we cannot guarantee that our food products are completely free from allergens or cross-contamination, as our kitchens handle common allergens including wheat, dairy, eggs, tree nuts, peanuts, soy, fish, and shellfish.
It is your sole responsibility to inform us of any food allergies, dietary restrictions, or health conditions that may be affected by our food products. Dewey's Pizza shall not be liable for any adverse reactions, allergic responses, or health complications arising from the consumption of our food products where you have failed to disclose relevant allergy or dietary information.
13. Governing Law and Jurisdiction
These Terms of Service and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America and the applicable state law of the state in which Dewey's Pizza's principal place of business is located, without regard to its conflict of law provisions.
You agree that any legal action or proceeding between you and Dewey's Pizza arising out of or relating to these Terms or your use of the Services shall be brought exclusively in the state or federal courts of competent jurisdiction located in the United States. You consent to the personal jurisdiction of such courts and waive any objection to the exercise of jurisdiction over you by such courts and any claim of inconvenient forum.
Notwithstanding the foregoing, Dewey's Pizza reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our intellectual property rights or confidential information.
14. Dispute Resolution
14.1 Informal Resolution
Before initiating any formal legal proceedings, you agree to first contact Dewey's Pizza at [email protected] and provide a written description of the dispute, the relief sought, and your contact information. We will attempt in good faith to resolve the dispute informally within thirty (30) days of receipt of your notice. If we are unable to resolve the dispute informally, either party may pursue formal dispute resolution as described below.
14.2 Binding Arbitration
EXCEPT FOR CLAIMS THAT QUALIFY FOR SMALL CLAIMS COURT AND CLAIMS FOR INJUNCTIVE OR OTHER EQUITABLE RELIEF, YOU AND DEWEY'S PIZZA AGREE THAT ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, OR THE BREACH, TERMINATION, OR VALIDITY THEREOF, SHALL BE SETTLED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) UNDER ITS CONSUMER ARBITRATION RULES, WHICH ARE AVAILABLE AT WWW.ADR.ORG. THE ARBITRATION SHALL BE CONDUCTED IN ENGLISH AND SHALL TAKE PLACE IN THE UNITED STATES AT A LOCATION AGREED UPON BY THE PARTIES OR, IF THE PARTIES CANNOT AGREE, AT A LOCATION DETERMINED BY THE ARBITRATOR.
The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Except as may be required by applicable law, neither party nor the arbitrator may disclose the existence, content, or results of any arbitration without the prior written consent of both parties.
14.3 Class Action Waiver
YOU AND DEWEY'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. Further, unless both you and Dewey's Pizza agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
14.4 Waiver of Jury Trial
BY AGREEING TO THESE TERMS, YOU AND DEWEY'S PIZZA EACH WAIVE THE RIGHT TO A JURY TRIAL TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
15. Term and Termination
These Terms of Service are effective as of May 23, 2026, and shall remain in full force and effect for as long as you use the Site or Services or maintain an account with Dewey's Pizza.
You may terminate your account at any time by contacting us at [email protected] and requesting account deletion. We will process your request within a reasonable timeframe.
Dewey's Pizza reserves the right, in its sole discretion, to suspend or terminate your access to the Site or Services at any time, with or without cause, and with or without notice, including but not limited to circumstances where:
- You have violated any provision of these Terms;
- Your conduct creates legal liability for Dewey's Pizza or harms other users;
- We are required to do so by law or a court order;
- We decide to discontinue offering the Services or any portion thereof.
Upon termination of your account or access to the Services, all licenses and rights granted to you under these Terms shall immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
16. Changes to These Terms
Dewey's Pizza reserves the right to modify, update, or revise these Terms of Service at any time in its sole discretion. When we make material changes to these Terms, we will notify you by posting the updated Terms on our Site with a new "Last Updated" date and, where appropriate, by sending an email notification to the email address associated with your account.
Your continued use of the Site or Services following the posting of revised Terms constitutes your acceptance of such changes. If you do not agree with the modified Terms, you must stop using our Services and, if applicable, close your account. No modification of these Terms by you shall be valid or binding unless made in writing and signed by an authorized representative of Dewey's Pizza.
17. Severability
If any provision of these Terms of Service is found by a court of competent jurisdiction or arbitrator to be unlawful, void, invalid, or for any reason unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable, while preserving the original intent of the parties as closely as possible.
The failure of Dewey's Pizza to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
18. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices, policies, or guidelines published by Dewey's Pizza on the Site, constitute the entire agreement between you and Dewey's Pizza with respect to your use of the Site and Services and supersede all prior or contemporaneous communications, representations, agreements, and understandings between you and Dewey's Pizza, whether written or oral, regarding the subject matter hereof.
Any rights not expressly granted herein are reserved by Dewey's Pizza. These Terms do not create any agency, partnership, joint venture, or employment relationship between you and Dewey's Pizza.
19. Force Majeure
Dewey's Pizza shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, governmental actions or restrictions, civil unrest, labor disputes, power outages, internet service disruptions, or acts of war or terrorism. In such events, Dewey's Pizza shall be excused from performance for so long as such circumstances persist.
